USA FAIR has decided to file a challenge to the constitutionality of New York State's eStop law in the Second Circuit of the United States Court.
The eStop law is similar to laws passed in other states that seek to infringe upon the free speech rights of law abiding former offenders to engage in political expression and e-commerce on social networks and other sites on the Internet. Since its inception thousands of law abiding former offenders have been removed from social networks, resulting in numerous infringements on First Amendment rights, including losing the ability to comment on news articles due to the requirement to sign in through Facebook.
Similar laws have been struck down in other states and we are very hopeful that we will succeed in New York. We are fortunate to have retained Kathy Manley, an Albany-based civil liberties attorney, who has been very successful at challenging sex offender registry restrictions throughout the state.
To help finance this litigation, we are seeking to raise $2,500 by March 1st in a dedicated e-Stop litigation fund.
While our New York members will be particularly interested in this challenge, all of our supporters should be interested as well because the Second Circuit is a very influential Federal Court in setting precedent.
